Guardianship Evaluations

If you are seeking guardianship of another person because the person is no longer capable of managing their affairs, you will need a guardianship evaluation service. A guardianship evaluation service is typically provided by a psychiatrist or guardianship doctor.

What Is a Guardianship Evaluation Service?

A guardianship evaluation service provides the legal documentation to establish guardianship of another person who is partially or completely incapable of managing their affairs. The guardianship evaluation seeks to determine findings based on two types:

Determine a finding of incompetency due to mental illness, mental deficiency, or advanced age. The person needs to be deemed at risk and unable to take care of themselves or their property. The court will make a determination by reviewing medical records and the written evaluation provided by a psychiatrist or guardianship doctor.

Determine a finding of limited capacity in which the person can perform some, but not all of their health, financial, and other important decisions without help from others. The court will make a determination based on a review of medical records and a written evaluation provided by a psychiatrist or guardianship doctor.
